User agreement between the user (User,
you) and Pall Mall Safe Deposit Travel Bureau Limited
(Pall Mall Travel, we). Please read these terms
and conditions of use (Terms and Conditions) before
using Pall Mall Travel's website (Site).
The Site
The Site is offered to you by Pall Mall Safe Deposit
Travel Bureau Limited, 116 Golders Green Road, London
NW11 8HB, Great Britain.
Acceptance of Terms and Conditions
You consent to the Terms and Conditions when you use
the Site, without qualification. If you disagree
with any part of the Terms and Conditions, you may not
use the Site in any way.
Pall Mall Travel's Services
Pall Mall Travel offers an online travel portal that
allows you to research and check for availability of
travel products and services to suit you and enables you
to make bookings online.
You can choose from a variety of services on the Site.
Pall Mall Travel offers you the ability to book
flights and hotel rooms and purchase travel insurance
directly via the Site. We also display general
information about travel, including destination guides.
Pall Mall Travel Acts as Agent only
Pall Mall Travel acts as agent for third party
suppliers such as airlines, hotels, insurance companies
and others (Travel Supplier). When you make a booking
via the Site, and your preferred travel product or
service is available, the contract will be between the
Travel Supplier and you. Pall Mall Travel is not a party
to the contractual relationship. For all package
holidays bought through the Site Pall Mall Travel acts
as agent fully bonded by ABTA ( ABTA No: 4712X).
Pall Mall Travel does not assume any responsibility
for the travel products and services provided by the
Travel Supplier and makes no representations or
warranties (express or implied) about the suitability or
quality of travel products and services featured on the
Site.
Information on the Site
While we have made
every attempt to ensure that the information contained in
this site has been obtained from reliable sources, Pall
Mall Travel is not responsible for any errors or
omissions, or for the results obtained from the use of
this information. All information in this Site is provided
'as is', with no guarantee of completeness, accuracy,
timeliness or of the results obtained from the use of this
information, and without warranty of any kind, express or
implied, including, but not limited to warranties of
performance, merchantability and fitness for a particular
purpose. In no event will Pall Mall Travel, its related
partnerships or trading names, or the partners, agents or
employees thereof be liable to you or anyone else for any
decision made or action taken in reliance on the
information in this Site or for any consequential, special
or similar damages, even if advised of the possibility of
such damages.
Pall Mall Travel offers all of the general information
on the Site for purposes of guidance only. Please note
that the published information may change at any time.
You need to check with the relevant Travel
Supplier, destination, embassy, or tourist office to
confirm the guidance is up to date. In particular,
with respect to passports, visas, and vaccination
requirements, Pall Mall Travel does not guarantee that
the information is always up to date and it is your
responsibility to ensure that you understand and comply
with all relevant passport, visa, and vaccination
requirements.
Pall Mall Travel does not guarantee that information on
the Site (including without limitation prices,
descriptions or dates) is free from errors or omissions
but we will use all reasonable endeavours to correct any
errors or omissions as soon as practicable once they
have been brought to our attention.
Travel Supplier Conditions
Any booking you make on the Site shall be deemed an
offer by you to purchase your chosen travel product or
service from the Travel Supplier. If your offer is
accepted you will receive a confirmation e-mail and a
contract is established. All travel products and
services featured on the Site are subject to
availability.
The Travel Supplier's terms and conditions (including
airlines' terms and conditions of carriage) will apply
in addition to those set out here. The Travel Supplier's
terms and conditions may include provisions relating to
payment procedures, default, liability, cancellations,
changes of bookings and refunds (if available) and any
other restrictions. As you move through the Site you
will see links to terms applying to specific offers (you
are advised to read those terms carefully) but please
refer to your particular Travel Supplier for full
details as to the applicable terms and conditions.
You are responsible for complying with any airline or
other Travel Supplier in relation to check-in times,
reconfirmation of flights, or other matters. In relation
to flight tickets, you are required to use all flight
coupons in order of sequence. If this requirement is not
met the airline may void the ticket.
E-Tickets
Please note that airlines have their own rules and
regulations with regard to e-ticketing. Pall Mall Travel
cannot be held responsible for non-compliance with these
regulations and strongly recommends that you check these
details with your airline in advance of travel.
Cancellation/Modification
Where the Travel Supplier allows you to cancel or modify
a travel product or service that you have already booked
or purchased, it is your responsibility to notify Pall Mall Travel
in writing of such request. For car rental and package
holiday cancellations or modifications such request
should be directed to the Travel Supplier. It may not be
possible to cancel or modify some products or services
or there may be specific requirements you will have to
meet. Pall Mall Travel accepts all forms of
written requests. Pall Mall Travel is unable to cancel
or modify a travel product or service prior to receipt
of your request. For hotel bookings it is possible to
cancel or modify your booking through the Site in
accordance with the hotel's specific terms and
conditions.
Payment
Full payment for all air and insurance products is
required at the time of booking. Payment methods other
than those stated on the Site will not be accepted and
no responsibility is accepted for cash sent through the
post. Pall Mall Travel will pass your credit card
details to the Travel Suppliers, who will take payment
for your hotel bookings in accordance with the relevant
hotel's terms and conditions.
Before payment is received in full, Pall Mall Travel is
not obliged to issue any tickets, confirmations,
vouchers, or other travel documents. However, you shall
in all cases remain liable for payment of the amounts
agreed for the travel products and services ordered. Pall Mall Travel
is an IATA Ticketing Agent - your tickets for scheduled
flights will be sent to you within 24 hours of payment
being accepted.
Payment can be made by all major debit and credit cards
as detailed on the Site. Pall Mall Travel reserves the
right to charge you in addition for any handling fees we
or the Travel Supplier incur in relation to bookings
made by credit card. You will be notified of the
relevant charges, if applicable. Pall Mall Travel
reserves the right to pass on any charges relating to
card charge backs. If your booking is being paid for
with a third party credit card we may require written
authorisation to be provided by the card-holder.
Further, in an effort to minimise the effects of credit
card fraud, we reserve the right to carry out random
checks and may request you to either fax or post to us
proof of your address and a copy of the credit card
before issuing any tickets.
Taxes fluctuate in line with exchange rates.
Use of the Site
The Site is provided on an 'as is' and 'as available'
basis.
Pall Mall Travel does not accept any liability in
respect of your ability to access or use the site at any
time or any interruption in that access or use or any
failure to complete any transaction.
Pall Mall Travel does not warrant that the Site is free
from computer viruses or other properties that may cause
loss or damage.
User Obligations
You agree to be bound by the following obligations,
including without limitation:
a) You accept financial responsibility for all
transactions made under your name or account
b) You must be 18 years of age or over and have legal
capacity.
c) You warrant that all information you provide about
yourself or members of your household shall be true and
accurate.
d) The Site must not be used for speculative, false or
fraudulent bookings.
e) The transmission of threatening, defamatory,
pornographic, political, or racist material or any
material that is otherwise unlawful is expressly
prohibited.
f) The Site and any content may not be modified, copied,
transmitted, distributed, sold, displayed, licensed or
reproduced in any way by you, except that one copy of
the information contained within the Site may be made
for personal, non-commercial use.
Denial of Access
Pall Mall Travel reserves the right to deny access to
the Site at any time without notice.
Liability of Pall Mall Travel
Pall Mall Travel will not be liable for any indirect or
consequential loss of any kind in contract, or otherwise
arising out of your use of this Site or any of the
travel products or services booked or purchased on the
site.
Where Pall Mall Travel is liable for direct loss this
will be limited to a maximum of the total price of the
products or services in respect of which a claim is made
(save for the case of death or personal injury in
respect of which there is no limit).
Links to Third Party Web Sites
Certain links in this Site connect to other Web Sites
maintained by third parties over whom Pall Mall Travel has
no control. Pall Mall Travel makes no representations as
to the accuracy or any other aspect of information
contained in other Web Sites.
Force Majeure
Pall Mall Travel shall not be liable for any failure in
the course of this Agreement if the same shall arise out
of a force majeure event. This shall include without
limitation government intervention, wars, civil
commotion, hijacking, fire, flood, accident, storm,
strikes, lockouts, terrorist attacks, or industrial
action affecting Pall Mall Travel or its suppliers.
Currency Conversions
Currency rates quoted in the Site are derived from a
number of sources and may not in all cases be updated
daily. You may wish to verify actual rates on the date
of booking.
Changes to the Site
Pall Mall Travel may change any aspect of the Site or
its content, including the availability of any
suppliers, features, information, database or content.
Copyright
The information contained in this site is copyrighted
and may not be distributed, modified, reproduced in whole
or in part without the prior written permission of Pall Mall Travel. The images from this site may not be
reproduced in any form without the prior advance written
consent of Pall Mall Travel.
Privacy Policy
The terms of the Pall Mall Travel Privacy Policy are
incorporated into these Terms and Conditions. You agree
to the use of personal information by Pall Mall Travel
and its affiliates or third party suppliers in
accordance with the terms of and for the purposes set
forth in the Pall Mall Travel Privacy Policy.
Changes to Terms and Conditions
Pall Mall Travel reserves the right to change or
update the Terms and Conditions relating to use of the
Site from time to time without prior notice to Users.
The current version of the Terms and Conditions will be
displayed within the Site from the date on which any
changes come into effect. Continued use of the Site
following any changes to the Terms and Conditions shall
constitute your acceptance of such changes.
Governing Law
This User Agreement is between you and Pall Mall Travel
and is governed by the laws of England and Wales.
